1. PROVIDER AND CONTACT
The Hosting Panel is provided by:
Pos-IT e.U.
Owner: Benjamin Pos

Austria

2. SCOPE AND CONTRACTUAL CONTEXT
These Terms of Use govern technical access to the Pos-IT Hosting Panel and use of the functions provided there by customers, resellers and authorised Pos-IT staff.
The Hosting Panel is an administration interface. Individual quotations, contracts, service descriptions, service level agreements, data processing agreements and Pos-IT business terms remain separate contractual documents. In the event of a conflict, individually agreed contract documents take precedence.
Mandatory consumer rights and other mandatory statutory rights are not restricted by these Terms of Use.
3. ACCESS AND USER ACCOUNTS
Access is intended exclusively for persons activated by Pos-IT or another appropriately authorised body. Users must provide correct and current information and may not allow another person to use their account.
Credentials must be kept confidential. Passwords must be sufficiently secure. Where two-factor authentication is available or required, the secret and recovery codes must be stored securely.
Any suspected loss of credentials, unauthorised access or other security anomaly must be reported to Pos-IT without delay. Pos-IT may temporarily lock accounts or customer areas to protect the systems.
4. ROLES, TENANTS AND PERMISSIONS
Access rights arise solely from the technical system role, customer or reseller assignments, and expressly granted permissions. A job title, company position or internal responsibility does not automatically extend technical rights.
Users may work only in the customer and tenant areas for which they are authorised. Resellers do not receive general access to other resellers, customers or Pos-IT administration functions and may not assign additional reseller accounts themselves.
Where several persons act for a customer, the customer must ensure that roles remain current and that users who leave or are no longer responsible are removed or reported without delay.
5. CUSTOMER AND MASTER DATA
Users must carefully review customer, billing, contact and payment data and enter changes truthfully. Pos-IT may generally rely on the information stored in the Hosting Panel for automated documents and processes unless an error is obvious.
Organisational data and centrally managed master data may be changed only by Pos-IT or expressly authorised roles. Information being visible does not automatically mean that a user may edit it.
6. HOSTING, DOMAIN, DNS AND SERVER FUNCTIONS
Changes to domains, DNS records, hosting assignments or server configurations may have immediate technical effects, including websites or email services becoming unavailable. Users must review changes before saving and may only manage data for which they are responsible.
Synchronisation displays distinguish between locally saved changes, jobs accepted for processing and changes actually applied by the external provider. A successful submission alone does not guarantee that an external change is already effective worldwide; DNS changes in particular may take time to become visible.
Pos-IT may reject, defer or, after consultation, correct changes that are risky, unlawful or technically impossible to execute.
7. CONTRACTS, PLANS AND SERVICES
Plans, allowances, terms, promotions and contract items displayed in the Hosting Panel reflect the contract data currently stored. The concluded contract and its schedules remain authoritative for the services owed.
Changes, transfers, cancellation requests and approvals are logged. A declaration identified as a request is completed only once it has reached the final status shown in the Hosting Panel or has otherwise been confirmed by Pos-IT.
Time-limited promotions change the regular plan price only for the period displayed. After the promotion expires, the regular price stored in the contract applies again unless otherwise agreed.
8. INVOICES AND PAYMENTS
Invoice drafts may be edited until finalisation. Only a finalised and archived invoice is the authoritative invoice version. Customers receive only invoices and documents released for them.
Due dates, payment references and payment status must be observed. An automatic allocation or display in the Hosting Panel does not replace actual credit to the relevant account.
Optional payment methods such as SEPA direct debit or recurring card payment require the necessary agreement, consent or valid mandate. Payment details may be stored or changed only by persons authorised to do so. A payment method may be disabled where it has not been fully configured or is no longer valid.
9. DOCUMENTS AND FILES
Only files required for contract or service administration and which the user is authorised to use, store and disclose may be uploaded.
Prohibited content includes malicious files, third-party confidential data without authorisation, unlawful content and content infringing third-party rights. Pos-IT may block or remove such files and restrict access to the upload function.
Finalised documents and audit evidence may be archived in an immutable form for legal or contractual reasons. Users are not entitled to overwrite the contents of such evidence retrospectively.
10. PERMITTED USE
The Hosting Panel may be used only for its intended business and administrative purposes. The following in particular are prohibited:
- bypassing roles, permissions, locks or security controls;
- accessing another party's customer, contract, payment or infrastructure data;
- automated bulk access without prior approval from Pos-IT;
- disruption, overload, manipulation or security testing without express permission;
- use for unlawful content, deception, misuse or infringement of third-party rights;
- disclosure of credentials or exports to unauthorised persons.
11. COOPERATION AND SECURITY
Users must follow customary security measures, keep devices up to date, end sessions on shared devices, and report identified errors or suspicious activity promptly.
Customers and resellers are responsible for the substantive authorisation of their users and for the accuracy of changes they initiate. Pos-IT remains responsible for central technical system roles and securing the Hosting Panel.
Security-related locks must not be bypassed. Unlocking may require an identity or authorisation check.
12. AVAILABILITY, MAINTENANCE AND CHANGES
Pos-IT endeavours to provide reliable operation. Uninterrupted availability is owed only where expressly agreed in a contract or service level.
Maintenance, security updates, error correction, provider outages or events outside Pos-IT's control may temporarily restrict functions. Planned material restrictions will be announced where reasonably possible.
Functions and user interfaces may be developed further, provided that this does not unreasonably impair the agreed core of a paid service.
13. EXTERNAL SERVICES
Individual functions may involve services provided by banks, payment providers, DNS or domain providers, data centres and email service providers. Additional terms may apply to their independent systems.
Pos-IT controls external providers only within the applicable contractual and technical possibilities. Displays such as “sent”, “synchronised” or “paid” must be understood only in accordance with the status actually confirmed by the external system.
14. BACKUPS AND CUSTOMER EXPORTS
The type, scope and retention of backups are governed by the selected plan or contract. A backup function visible in the Hosting Panel does not create an additional backup obligation without a corresponding service agreement.
Where export functions are provided, the customer is responsible for retaining required copies promptly and securely. Documents that Pos-IT must archive by law or contract remain unaffected.
15. LIABILITY
Pos-IT is liable in accordance with applicable law and the individually agreed contractual provisions. Mandatory liability, in particular for wilful misconduct or gross negligence, personal injury, product liability or mandatory consumer rights, is not excluded or restricted.
To the extent permitted by law, Pos-IT is not liable for losses caused solely by incorrect customer data, unauthorised user actions, changes not approved by Pos-IT, disregard of clear warnings, or disruptions outside Pos-IT's reasonable control.
Users remain responsible for reviewing particularly high-risk changes. Liability provisions in the relevant individual contract take precedence.
16. DATA PROTECTION AND CONFIDENTIALITY
Information on the processing of personal data is provided in the Privacy Policy linked in the Hosting Panel.
Users must keep other persons' or companies' personal, contractual, technical and business data confidential. Exports and documents must be stored and transmitted in a way that prevents unauthorised access.
17. COPYRIGHT AND RIGHTS OF USE
The software, design, texts, templates, logos and other Hosting Panel content are legally protected. Users receive only the non-transferable right of access necessary for use in accordance with the contract.
Customer-owned content and data remain attributed to the respective rights holder. By uploading them, the authorised person grants Pos-IT only those rights of use necessary for storage, processing, backup and provision in accordance with the contract.
18. CHANGES TO THESE TERMS OF USE
Pos-IT may update these Terms of Use when the Hosting Panel, the law or security requirements change. Material changes will be announced in an appropriate manner. Where express consent is legally required for a change, it will be obtained separately.
19. GOVERNING LAW AND FINAL PROVISIONS
To the extent permitted by law, Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protections of the country in which a consumer has their habitual residence remain unaffected. Jurisdiction clauses apply only where legally permitted and validly agreed.
If any provision is or becomes invalid, the remaining provisions remain unaffected. Statutory provisions apply in place of the invalid provision.
The German and English versions serve the same information purpose. In the event of differences in interpretation, the German version prevails to the extent legally permissible.
